In the preamble of the Constitution of the People’s Republic of Bangladesh the fundamental aim was set, realizing a socialist society, free from exploitation, through a democratic process where fundamental human rights, freedom, equality, and justice will be secured. Where the will of people, the Constitution will be the supreme command and will be protected and followed. Which means, the pledge was ultimately about ensuring the Rule of Law. Because, if rule of law is ensured, which means the constitution is held the supreme command and followed properly, the fundamental principles will be followed, the fundamental rights will be ensured, every organ of the state will perform properly. Overall, the sole purpose or fundamental aim as mentioned in the Constitution of the People’s Republic of Bangladesh will be served. But today there are lot of violations of fundamental rights of the people, arbitrary use of power by Government and its organs, difficulties in access to justice, inequality, etc. Which are against the fundamental aim mentioned in the constitution. Therefore, the question arises, whether complete Rule of Law exists, or it is just a myth, or mere words written in a document? This study is made to find out whether Rule of Law exists in Bangladesh, or it is just a myth. To point out the difficulties in ensuring Rule of Law and their causes. |
